    I am watching a “special” presentation about the girls of Charles Manson as I try to type this. Black Panthers be dammed. There over. If they ban belt loops on peoples pants, I will forever be in THIS IS MY ASS HELL. I do not want people to have to see the split that GOD gave me. Hell, I DON’T want to see it.

    Are they not considered “semi auto machineguns” ?
    Some liberal politicians have already used the term- fully semi automatic.
    Some think the ban is just the first incremental step towards reclassifying all semiautos as full autos.

    TNcitizen; you prove once again that it is impossible to be sarcastic about leftists. Every sarcastic joke one can make about them ends up being true.

    Decades ago I joked, saying that the leftists, if they kept it up, would be banning kitchen knives. Now the mayor of London is actually, seriously proposing a ban on kitchen knives.

    Nothing is too ridiculous for an authoritarian. Nothing is too insane for a leftist. Nothing is too horrible or too dishonest for a socialist. Nothing is too deceptively evil for a papist, Jesuit or Islamist. AND the United States government is supporting all of it, flabbily pretending to oppose it while withholding the one meaningful alternative.

    The pieces hang in a plastic bag just inside my door, should I need to prove it was destroyed.

    There is some chance that I may be checked since I vocally opposed the president unconstitutionally changing our firearms laws. Congress has the right to write or amend laws, not the executive branch. I sent a message to the White House and posted a statement during the public comment period on the Federal Register in an effort to protect our rights.

    So I could be targeted.

    These are un-serialized items. Anyone could be targeted. Can you prove you didn’t buy one ?

    Without proof of a destroyed one, you can be accused of having one hidden. You can’t prove that you don’t have one hidden. In combination with “red flag laws” in some places, things could get dangerous for anyone, anywhere, anytime even if they own no firearms.

    The ATF wanted us to make an appointment to surrender one. If you are targeted how likely is it that they will make an appointment with you ?

    It is more likely that they will catch you dancing naked in the middle of the night.

    They say they aren’t going to do much with this because they don’t have funds allotted. But since the fine for a violation is two hundred and fifty thousand dollars, it looks like they have incentive to simply collect lots of funding.

    I commend you for exercising your 1A Rights of Free Speech and Petitioning for Redress of Grievances. But, don’t be concerned about your name being “on a list”. If anyone reading this is NOT “on a list” by now – somewhere, for some reason – then, you aren’t living. You WANT your name on every list available, so TPTB will know you can – and will – make a very big stink that will only spray back on them if they go after you. And, if an overzealous Prosecutor targets you for exercising a Constitutionally-protected Right, you will be able to pad your twilight years with the proceeds from the lawsuit you win against the ba$stard.

    No Defendant has any obligation to prove that they did not commit a crime. It’s the Prosecution’s responsibility to prove that a Defendant committed a crime. That’s basic ‘Law-School 101’. Didn’t you ever watch “Perry Mason”? Reruns are on TV all the time; I suggest you catch a few episodes.

    Your concern about EPRO’s (so-called ‘Reg-Flag Laws’) is valid. But, same rules apply as in LS-101.

    I envy your trust and faith in the justice system and the agents of law enforcement.
    Your description of defendants rights assumes that due process is in place.
    That is the problem with the spreading Red Flag Orders. It allows law enforcement to act on mere accusation.
    Then due process is allowed after you have become a defendant and your property has been seized.

    Having been “Swatted” before and getting a request from the F.B.I. to surrender a firearm for their inspection, I have a different perspective.

    Facing an officer in Swat gear with his M4 in low ready position is unsettling. You know one wrong move can result in your death.

    If this were to happen to you, your perspective might change.

    I have experience and reason that makes me lean toward paranoia. I wish it was not so.

    I have no criminal record at all, and I have legally carried every day for over twenty years.

    Being surrounded by police with their guns trained on you, then being cuffed, read your rights, and being interrogated is disturbing when you are innocent of anything.

    I wish I could trust and like the police like I used to. Now I am afraid of what they might do to me.

    You are correct, No defendant has any obligation to prove they did not commit a crime.
    You have the right to “Stand Mute” and trust that a judge or jury will decide in your favor.
    In the initial contact with law enforcement, once arrested and read your rights, you have the right to remain silent. This most often will lead to a jail cell where you can sit until a hearing to decide if you will be allowed to make bail.
    If you are allowed to make bail, you are set free but must then appear in court as a defendant at a later date.
    If you are not allowed bail, you may sit in jail until a hearing is set. Then you return to jail until your trial begins.

    A lot can happen before you ever gain defendant status.

    You suggested that I watch Perry Mason re-runs.

    I watched Perry Mason when it was originally broadcast.

    I would suggest that we should not make decisions,form opinions or give advice based on television programs.

    We have judges and grand juries that should decide whether a citizen’s complaints about another citizen meet legal standards to warrant a police action against someone. Due Process.

    Letting the police decide to take action based on a claim bypasses Due Process.

    An ex-spouse, irritating neighbor, or someone that just doesn’t like your looks can cause you misery and ruin, without Due Process.

    “Swatting” is the highest form of abuse of Due Process.

    The ban on the two pieces of plastic only adds to the whole problem. As I said anyone could accuse anyone of possessing one. Remember when the president announced he would have them re-classified- he said “they’re gone” and ” we’ll worry about due process later”.

    Evidently you feel you have a strong power of persuasion and should the authorities knock on your door , they will be understanding, accept your denial,
    and see no reason for search or seizure.
