That must have been by accident because it certainly wasn’t by intent.

This is the problem with “partisan” politics, even at the judiciary level. Conservative judges tend to defend certain amendments and rights while trampling over others. Liberal judges to the same thing, just with often opposite amendments and rights than the conservatives.
They’ll defend the rights that support their political view, and compromise the rights that are “icky”.

Matt has it exactly right. I’d love to run into a judge who actually takes the Constitution seriously. I don’t believe any have been alive in the past 100 years, and it’s not clear any have in the history of the Republic.
