All it takes is one peckerwood with a black robe wrapped around some leftist ideology to run a company out of business, or at least cost them a shitload of money defending themselves in court.
Crap like this was why the PLCAA was passed. Although sometimes it seems like it was written in crayon, considering how some judges seem to ignore its existence.

As I recall, the previous case cost the official plaintiff a bunch of money and Brady refused to help them pay. You would have to have a heart of stone not to laugh.
