They snagged me or the Mrs. this past week. $50 for running a red light we didn’t know we ran. I looked it over and, unlike other cases, it actually was our vehicle. I read the bottom and it basically said something to the effect of:
Under penalty of perjury, I have reviewed . . .
And the officer signed it affirming a violation had occurred. I guess that explains their quick response to Tam since, through carelessness, said officer had perjured him or her self in that case.

I’d fight that shit. If you don’t know you ran that light, take them to court and say you didn’t. They have to prove it beyond reasonable doubt… make them do it.

Do they show the light in a state of redness in the photo?
If not, then it is simply a photograph of your car.

It isn’t running a red light if it changes while you are in the intersection.

I’ll give ’em this: From what I can tell, the cameras don’t start flashin’ unless your rear axle has crossed the sensor after the light’s turned red.
The ethics of the whole setup? Well, that’s another topic altogether. R2D2 ain’t a sworn law enforcement officer, nor even a citizen…

PS: I hadn’t noticed the “perjury” bit on my own citation. I hope officer XXXXXX got a stern talking-to, if not an actual perjury charge. 😉

If you didn’t know you ran it, it may have been that the time the yellow held on that light was shorter than lights around it. I got nailed by a light like this in Maryland. I didn’t do a research project on it but the light clearly went red faster. Paid the ticket and avoided that intersection from then on. I made it a point not to there for any reason even driving further the patronize other businesses. Not a big sacrifice since the intersection was clogged most of the time and unpleasant to traverse.

I just got handed an unrelated $60 citation. Although I’m sure I didn’t commit the crime, just take a look at the economics of the whole deal. You have to take an entire day off and even if you win, you still have to pay court charges (no loser pays here). Furthermore, I’m sure that there’s some kind of standard mischief in place that keeps you from suing the state to recover your lost time. So you’re in a hole already without even being assured that you will win.
Now factor in that you are guilty unless proven innocent, and that the courts are colluding with the police for the purpose of revenue enhancement (RICO anyone? Oh yea they’re exempt.)
Unless you have compelling evidence proving you are innocent, it does not pay to show up unless you wish to negotiate away your points (and I believe that it’s a fine only in this case)

I didn’t realize it got shots of the driver and light too. I once got one for the EZ-pass thing (it malfunctioned, and they didn’t have my tags from the new car in the system), and it just had a snap of the plate. A call to the EZ-pass people fixed the problem.

Tam – That’s a problem. It should be based on the front axle. If your front axle is over the line before the light turns red, you are allowed to complete your travel through the intersection.

So, which of you is being “charged” with the violation? If the picture doesn’t make it clear which of you it was, then make them prove which of you it was. They can’t convict you of your wife’s violation, they can’t convict her of yours. After all, can they even prove it was one of you, as opposed to a friend you let borrow your car?
They should be ticketing the driver of the car, not the owner.
