Ron Paul addresses TSA
By introducing a bill to rein in the TSA:
No law of the United States shall be construed to confer any immunity for a Federal employee or agency or any individual or entity that receives Federal funds, who subjects an individual to any physical contact (including contact with any clothing the individual is wearing), x-rays, or millimeter waves, or aids in the creation of or views a representation of any part of a individual’s body covered by clothing as a condition for such individual to be in an airport or to fly in an aircraft. The preceding sentence shall apply even if the individual or the individual’s parent, guardian, or any other individual gives consent.

So he’s expecting a wave of lawsuits to destroy the TSA?

looks to me like it may allow going after the individual too, and not just an agency. that would make a difference.

but the airports are already reining in the TSA, and will replace them with security folks from one of 5 pre-approved firms.
Which, are probably going to end up filled with soon to be ex-TSA agents and they will not be subject to the laws, because they are not federal employees, but only doing their job.
I bet they will be union too.

And they STILL have to follow TSA regulations and procedures….according to the TSA.

The point is, this would open TSA (or their contracted substitutes) to civil suit. No immunity.

Seems like it would be simpler to just ban the use of the backscatter x-rays, and the like.

The reasoning that the TSA gives for these new procedures is that there is a credible threat that the TSA is defending against. Fair enough, except that the current procedures would not find any explosives hidden in ones stomach or rectum. If they get credible threats in that direction, will we then be “rightly” subject to cavity searches or x-rays? The point is that the line is absolutely subjective. And that they have crossed the public’s and my view of that line.
