If a NICS check doesn’t come back, well, then it’s not instant. And, apparently, the FFL has discretion on whether or not to initiate the sale. Except that, someone claims, ATF tells the dealer they have no discretion, even though this goes against their own guide to regulations. Fits right in with ATF’s policy of making it up as they go along.

It usually takes me a week to get through the hassle of NICS. I’ve been screaming for a while about it, and the worst part about it is they don’t save the update to the record.
Instead they see charged with felony (6 years ago), hold transaction for digging. They proceed to verify it was dropped, after which they release the hold and allow me to complete the purchase. Now for 48 hours I’ll have an “instant” NICS check. Then they dump the record and I get to go through all the crap over again, because of the same exact ding on the record.
The whole system is horse shit because they way you fix it is by paying money to the ATF.

The Dealer always has discretion.
To Barron: Apply for a a UPIN (line 9 on the NICS form) to avoid the wait, if you’re cleared.

Which costs money. Why do I have to file for a UPIN and pay money for them to retain a record they already have?
Not to mention the blank stares I got when I walked into the regional ATF office to get information on getting a UPIN.
