I guess I should be expecting papers from Marlin/Remington any day now……

Given I was threatened with exactly the same thing by another corporation for simply reporting my experiences with their piece-of-crap masquerading as a firearm… I cannot say as though I am surprised.

You’d think companies in a highly competitive market would try to avoid looking this bad. Well, with the plethora of aftermarket AR parts available, it just makes it easier for me to chose which $THING to buy if I can scratch Smith off my list. (Along with Troy Industries)

The lawsuit is a loser, it’s the harassment value. Having to hire a lawyer to fight it. Even if you win you’ve lost.
Personally, I would never buy a Smith Enterprises, Inc. receiver because I would be afraid to fire it that close to my face. But that’s just my opinion. I have absolutely no knowledge or information that the receivers are really made in China, by nine-year old Chinese children, working twelve hour shifts on shaft-and-belt driven milling machines from recycled steel from old Trabants. Nope, no information of that kind at all. I am not saying that. Neither am I saying that the lead and aluminum in the steel turns into a fine vapor every time the gun is fired, leading to infertility, birth defects, and Alzheimer’s disease. Again, I have absolutely no information that such is the case. It is simply my belief, and my personal choice not to take the risk in case I am right. You are free to do as you think best.

WOW. I checked out the page views. M14 forum put this thread into the general forum area so lurkers could read it. from what I understand, it’s now floating to other forums and the word is spreading like wildfire.
Hammonje has set up a legal defense fund and it looks like SEI is about to have their day in court. I don’t think it’s going to go like they planned.

SE’s failure to enumerate any damages will probably get this tossed out at the initial show cause hearing.Unless Arizona is full retard.

I’m more curious about the prior restraint.
Not that I ever would say that Smith Enterprises, Inc. are worthless losers who cannot compete in the marketplace and need to sue to shut up their critics — no, I would never say that — but I would like to know whether I can be enjoined from saying it by a court the First Amendment notwithstanding.

You know what bugs me the most about this? They claim that they where working too hard to post on the forums explaining why there was a hold up on their product… And then go through the effort of writing up a 12 page document explaining why they’re suing someone for stating that he heard there where issues. Not that there where issues, not that the issues would be present in the final product. Just issues that delayed the product. How much LESS time would it have taken to simply post “Hey, we’re not having heat treatment issues, we’re just *insert reason here*. Sorry about that. Bear with us, and we’ll have a good product for you” or something like that? As a result? I’m not buying from SEI ever. Funny, I would have never heard of this, and might have been keen on one of their flash hiders, but their actions made me aware of this, and makes me not want to buy their products (not because of heat treating, mind you).

I love how many commenters, both here and on M14, don’t get the difference between a state court and federal court. But, I bet these same people vote and forward a boat load of political non-sense emails.

The folks at SEI really should have read up on the Streisand effect http://en.wikipedia.org/wiki/Streisand_effect . Before this I’d never heard of them, now I’m sure to avoid them like the plague.

I love how many commenters, both here and on M14, don’t get the difference between a state court and federal court.
And the difference is …?
Why, bless your heart, one is federal and one is state.

So basically you’re saying that it’s too late for them to call on the phone, say there was an overenthusiastic junior employee, and send along a free tour invite and a discount coupon? No T-shirt?
They wouldn’t…say uncle?
Wait until they get a load of the defendant’s legal team. To coin a phrase, “Heh.” They’ll be lucky not to get Dr. Helen on the stand dissecting their mens rea.

They didn’t offer me anything. They were just courteous, professional and they apologized.

I would never buy a product from people who sue over bad internet reviews.

Unless Arizona is full retard…
Well, they do keep electing John McCain. Wasn’t the gun control astronaut from there also?
Just sayin’

So the guy said that the receivers were made in China, so they are suing him, surely it was more than that.
What did he say?
