    Of course, I guess the fact that this was the Secret Service doing the arresting, and they are under the control of the President, that has no real bearing on using this to bash Democrats.

    Except the Secret Service didn’t arrest him. The local guys did, held him, and charged him. The only reference I noticed was that the Secret Service questioned him for an hour and their spokesperson acknowledged that it did happen and they looked into the matter.

    If the Secret Service was doing the arresting, it would be with the FBI. This guy was hauled away and charged by Colorado police under Colorado law, not Federal.

    This event has me enraged to the point of seeing red. I’ve commented on this on my blog but the basic gist is: If this guy wasn’t in violation of a law requiring him to have a license for mere possession of his arms, then his arrest is illegal and invalid under FOPA’86. It is not a fucking crime to walk into a hotel with rifle or pistol cases if you transport of them is in accordance with Federal law (encased, unloaded, no ammo in the case).

    Damn straight I will use this to bash Democrats. I would argue had it been anyone else, nothing would have happened. I would go as far to say the local police probably doesn’t like armed citizens (as per any large urban area) and this played right into their biases. And because of Pelosi’s presence, what might have been a stern talking to because an example of “How dare the peons presume to claim rights I don’t want them to have!”.

    And they’ll crucify this man for it by hook or by crook to make sure that the rest of us stay in our proper places.

    Enough is enough. This is not law-enforcement. This is not keeping the peace. This is the full force of government to strip us of rights and freedoms by the use of or threat of naked force of which we are unable to resist.

    We have to stop it. We need new laws, elect new judges and sheriffs, something, anything. Otherwise, we’ll be free so long as we don’t speak. Cowed and submissive, free only in name.

    they start the bureaucratic nonsense the world is coming to. We are no longer controlled by law but by fiat.

    It will get a lot worse before it gets any better.

    Yes, Denver the city is rather anti-gun. Has its own set of laws and is rather nasty about enforcing them.

    Oh good god – he’s apologizing for creating such a ruckus! Usually I think comments like Matt’s about “cowed and submissive” are hyperbole, but in this case…

    Arrested for carrying cased firearms without a CWP? We can only imagine how many officers would have opened up on him if he’d been carrying them openly.

    Or, ya know, maybe they were erring on the side of caution. I hate that the guy was inconvenienced, but the truth came out, no?

    I’d say the local guys are directed by their guys at the top, and since the Convention is big news, well, you guys understand how this stuff happens right? Limelight is on the city, so their guard is up.

    I understand why the cops would have been called. I understand them confronting, detaining, and questioning the man. I cannot understand them placing him under arrest assuming his rifles were in cases and his handguns were in his luggage. It is legal to posses rifles and shotguns in Colorado. Period. This does not change because Nancy Pelosi is in town.

    I understand, BWM, and I myself don’t like it. I do think they over-reacted in this case, and do owe the man an apology. But at the same time, I understand why it happened.

    I think that when a big event like this is going on, police on duty, as well as private security (like Hyatt security) are hyper sensitive to ‘what-could-happen’. And since everyone wants to understandably cover their own asses, this is what ends up happening.

    Barack Obama has definitely had his fair share of crazies threaten, and the secret service are well aware of this. Ditto for the local PD, i’m sure.

    I would really expect no less to happen, really, if a private citizen came armed to the upcoming Republican Convention in St. Paul. Lots of powerful pols milling about, with a Police force on the lookout. Better safe than sorry as the guiding principle.

    Not that I agree with it.

    uh, the Denver cops aren’t under the command of the Democrats, they are under the command of the city of Denver and are probably taking marching orders from the Secret Service as well. I suspect that if the same thing happens next week in Minneapolis, you would a similar result.

    I am a multiple gun owner, have a carry permit, and don’t owe my loyalty to any particular political party, but don’t let that stop you from your ad hominim attacks. You can resume your hate fest at this time. God bless America, eh?

    The point is that no laws were broken, that anyone can identify. Charged with unlawful carry? Won’t stick. His guns were in a locked case at a hotel, which is often treated similar to a residence.

    They reported he was charged. Not that he broke the law. He has been charged (likely incorrectly, under the FOPA) for unlawfully carrying a firearm. He was not carrying and transport of firearms is protected under the FOPA.

    The article doesn’t say what he did that was allegedly illegal – other than something that Uncle and I know isn’t illegal. FOPA specifically disallows prosecutions in those cases. (Which doesn’t stop NY and NJ from arresting people, and then forcing them into defending themselves, citing FOPA, and then attempting to regain their property.)

    Except that by todays standards, JFK was a total right wing nutjob. Biggest tax rate cut in history, started multiple unilateral foreign wars, shot AR-15s on the White House lawn… What a goddamn neocon!
